GTEC Training Ltd Terms and Conditions

These Terms and Conditions govern all bookings, training courses, assessments, examinations and related services provided by GTEC Training Ltd ("GTEC", "we", "our" or "us").
By making a booking with GTEC, you confirm that you have read, understood and agreed to be bound by these Terms and Conditions.
1. Definitions
In these Terms and Conditions:
Delegate means the individual attending a course, assessment, examination or training programme provided by GTEC.
Booking means a reservation made for a course, assessment, examination or related service.
Course means any training programme, assessment, examination, workshop, webinar, qualification, certification programme or related service provided by GTEC.
Awarding Organisation means any awarding body, certification body, registration body, competent person scheme or regulatory organisation associated with a course.
2. Agreement
2.1 These Terms and Conditions override any marketing materials, brochures, website content, advertisements or verbal statements made by GTEC unless expressly confirmed in writing.
2.2 An agreement is formed when GTEC issues written confirmation of a booking and full payment has been received, unless alternative payment arrangements have been agreed in writing.
2.3 Delegates must review all booking confirmations and joining instructions carefully and notify GTEC of any errors within five (5) working days.
2.4 GTEC reserves the right to refuse any booking at its sole discretion.
2.5 GTEC reserves the right to amend these Terms and Conditions from time to time. The latest version will be published on our website and shall apply to all future bookings.
3. Consumer Cancellation Rights
3.1 Where a delegate is purchasing a course as a consumer, they may have rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3.2 Consumers normally have a fourteen (14) day cooling-off period from the date of booking.
3.3 Where a delegate requests that training, assessment, administration, registration or certification activities commence during the cooling-off period, the delegate expressly agrees that GTEC may begin providing services immediately.
3.4 If services have commenced within the cooling-off period, GTEC reserves the right to charge for services already provided and any third-party registration or administration costs incurred.
3.5 The cooling-off period does not apply where services have been fully performed.
4. Payment
4.1 Full payment is required at the time of booking unless otherwise agreed in writing.
4.2 No booking shall be confirmed until payment has been received in cleared funds.
4.3 Payment may be made using approved payment methods made available by GTEC.
4.4 Any payment that is dishonoured, reversed or disputed may incur administration charges.
4.5 GTEC reserves the right to amend course fees at any time prior to booking confirmation.
4.6 Course fees remain payable in full irrespective of whether a delegate successfully achieves certification, registration or qualification.
4.7 All fees are exclusive of VAT unless expressly stated otherwise.
5. GTEC Obligations
5.1 GTEC shall provide the course, training, assessment or examination services specified within the booking confirmation.
5.2 GTEC shall use reasonable skill and care in delivering all training services.
5.3 Where applicable, GTEC shall arrange examinations, assessments and certification processes subject to awarding organisation requirements and availability.
5.4 GTEC reserves the right to substitute trainers, assessors, venues, learning materials and delivery methods where necessary.
6. Delegate Obligations
6.1 Delegates must attend training during the times specified in joining instructions.
6.2 Delegates must behave professionally and respectfully towards staff, contractors and other delegates.
6.3 Delegates must provide accurate information during booking and registration processes.
6.4 Delegates must satisfy any stated entry requirements, prerequisites or experience requirements applicable to a course.
6.5 Delegates must comply with all health and safety instructions and site rules.
6.6 Delegates must maintain the confidentiality of any login credentials provided for online learning systems.
7. Rescheduling Policy
7.1 Any request to reschedule a course, assessment, examination or training programme must be submitted in writing and will only be effective once confirmed by GTEC in writing.
7.2 Where a delegate requests to reschedule a booking more than twenty-eight (28) calendar days before the scheduled course start date, GTEC will permit one reschedule without charge, subject to course availability.
7.3 Where a delegate requests to reschedule a booking between fourteen (14) and twenty-eight (28) calendar days before the scheduled course start date, GTEC will permit one reschedule without charge, subject to course availability.
7.4 Where a delegate requests to reschedule a booking fewer than fourteen (14) calendar days before the scheduled course start date, a rescheduling fee of £150 plus VAT shall be payable before the new course date is confirmed.
7.5 Rescheduling requests made within five (5) calendar days of the scheduled course start date will not normally be accepted and shall be treated as a cancellation in accordance with Section 8 of these Terms and Conditions.
7.6 Only one reschedule shall be permitted in respect of any booking. Any subsequent request to amend, postpone or transfer a booking may be treated as a cancellation and the cancellation provisions set out in Section 8 shall apply.
7.7 Rescheduled bookings must normally be taken within six (6) months of the original course date unless otherwise agreed in writing by GTEC.
7.8 Any fees incurred by GTEC in registering a delegate with an awarding organisation, certification body, registration scheme or funding body prior to the reschedule request may be payable in addition to any applicable rescheduling fee.
7.9 Rescheduling a booking does not alter the contractual terms, pricing structure, prerequisites, assessment requirements or other conditions applicable to the original booking unless expressly agreed in writing by GTEC.
7.10 GTEC reserves the right to refuse a reschedule request where course availability, operational requirements, certification deadlines, awarding organisation requirements or other reasonable business considerations make a transfer impractical.
7.11 Where a delegate fails to attend a rescheduled course date, the booking shall be treated as a non-attendance and no refund, transfer or further reschedule shall be permitted.
7.12 Any promotional pricing, discounts, package offers or special offers applied to the original booking may cease to apply following a reschedule and GTEC reserves the right to charge the prevailing course fee applicable at the time of the new booking date.
8. Cancellations and Refunds
8.1 All cancellation requests must be submitted in writing by email to GTEC. A cancellation will not be deemed effective until acknowledged by GTEC.
8.2 Where a delegate cancels a booking more than twenty-eight (28) calendar days before the scheduled course start date, GTEC will provide a full refund of any course fees paid.
8.3 Where a delegate cancels a booking between twenty-two (22) and twenty-eight (28) calendar days before the scheduled course start date, GTEC will retain twenty per cent (20%) of the booking value and refund the remaining balance.
8.4 Where a delegate cancels a booking between fourteen (14) and twenty-one (21) calendar days before the scheduled course start date, GTEC will retain fifty per cent (50%) of the booking value and refund the remaining balance.
8.5 Where a delegate cancels a booking fewer than fourteen (14) calendar days before the scheduled course start date, no refund shall be payable and the full booking value shall remain due.
8.6 Failure to attend a course, assessment, examination or training programme without prior written notice shall be treated as a cancellation with fewer than fourteen (14) calendar days' notice and no refund shall be payable.
8.7 Where a delegate has been registered with an awarding organisation, certification body, registration scheme or funding body, any fees already incurred by GTEC on behalf of the delegate may be deducted from any refund payable.
8.8 Where GTEC cancels a course, delegates may choose one of the following options:
(a) a full refund of fees paid;
(b) transfer to an alternative course date; or
(c) a credit note to be used against future training services.
8.9 GTEC shall not be responsible for reimbursing any travel, accommodation, subsistence, loss of earnings, loss of opportunity or other consequential costs incurred by delegates in connection with a cancelled or rescheduled course.
8.10 Where a delegate fails to respond to GTEC regarding a cancelled course within six (6) months of notification, GTEC reserves the right to close the booking and any entitlement to a refund, transfer or credit may lapse.
8.11 Refunds will be processed using the original payment method wherever reasonably possible and within a reasonable period following approval.
8.12 Any refund due shall be limited to the fees paid directly to GTEC and shall not include any third-party costs or expenses incurred by the delegate.
9. Re-sits and Additional Training
9.1 Delegates who do not successfully complete an assessment, examination or practical evaluation may be required to undertake additional training or re-assessment.
9.2 Additional training, registration fees, examination fees and assessment fees may apply.
9.3 Current re-sit fees are available upon request and may change without notice.
10. Recognition of Prior Learning (RPL)
10.1 Fees paid for Recognition of Prior Learning applications are non-refundable.
10.2 Acceptance of an RPL application does not guarantee successful achievement of a qualification.
10.3 RPL outcomes are determined solely in accordance with applicable assessment and quality assurance requirements.
11. Course Changes and Amendments
11.1 GTEC reserves the right to cancel, postpone, relocate or amend any course where necessary.
11.2 Course content may be updated to reflect legislative changes, industry developments, accreditation requirements or awarding organisation requirements.
11.3 Any increase in certification, registration, examination or awarding organisation fees after booking may be passed on to delegates.
11.4 GTEC may substitute an equivalent qualification, certification route or awarding organisation where appropriate.
12. Assessment, Certification and Awarding Organisations
12.1 Successful completion of a course does not guarantee certification, registration, employment or competence.
12.2 Certification is subject to the delegate satisfying all assessment criteria and any applicable requirements imposed by awarding organisations, certification bodies or registration schemes.
12.3 GTEC cannot guarantee that a delegate will successfully complete any assessment, examination or certification process.
12.4 Decisions made by awarding organisations, certification bodies or registration schemes regarding certification, registration, suspension or withdrawal of qualifications shall be final, subject to applicable appeals procedures.
12.5 GTEC shall not be liable for any losses arising from a delegate's failure to obtain certification or registration.
13. Health and Safety
13.1 Delegates must comply with all health and safety procedures and instructions.
13.2 Delegates must immediately report accidents, incidents, unsafe conditions or near misses.
13.3 Delegates must wear any required personal protective equipment (PPE).
13.4 Delegates must disclose any medical condition or circumstance that may affect safe participation.
13.5 GTEC reserves the right to prevent participation in practical activities where safety may be compromised.
14. Suspension and Removal
14.1 GTEC reserves the right to suspend or remove any delegate who:
- Breaches these Terms and Conditions;
- Behaves in a disruptive, abusive, threatening or discriminatory manner;
- Commits plagiarism, cheating or assessment malpractice;
- Fails to comply with health and safety requirements; or
- Poses a risk to staff, delegates, facilities or reputation.
14.2 No refund shall be payable where removal occurs under this clause.
15. Intellectual Property
15.1 All course materials, training resources, manuals, presentations, videos, digital content and intellectual property rights remain the property of GTEC or its licensors.
15.2 Delegates may use course materials solely for their own personal learning and development.
15.3 Course materials must not be copied, reproduced, distributed, shared, sold, published or adapted without prior written consent.
15.4 Photography, video recording and audio recording during courses are prohibited unless expressly authorised by GTEC.
16. Data Protection
16.1 GTEC processes personal information in accordance with its Privacy Notice and applicable data protection legislation.
16.2 Delegates acknowledge that personal information may be shared with awarding organisations, certification bodies, funding agencies, employers, regulators and authorised third parties where necessary for the administration of training services.
16.3 Delegates are responsible for ensuring information supplied to GTEC remains accurate and up to date.
17. Limitation of Liability
17.1 Nothing in these Terms excludes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation; or
- Any liability that cannot legally be excluded.
17.2 Subject to clause 17.1, GTEC's total liability arising from any booking or course shall not exceed the total fees paid by the delegate for that course.
17.3 GTEC shall not be liable for:
- Loss of profit;
- Loss of business;
- Loss of contracts;
- Loss of earnings;
- Loss of opportunity;
- Indirect or consequential losses.
17.4 Delegates remain responsible for ensuring they have appropriate insurance cover where necessary.
18. Force Majeure
18.1 GTEC shall not be liable for delays, interruptions or failure to perform its obligations where caused by circumstances beyond its reasonable control.
18.2 Such circumstances include, but are not limited to:
- Severe weather;
- Flood;
- Fire;
- Pandemic;
- Industrial action;
- Utility failure;
- Cyber incident;
- Government restrictions;
- Venue closure;
- Trainer illness;
- Failure of suppliers or awarding organisations.
19. Complaints
19.1 Any complaint should be raised as soon as reasonably possible.
19.2 Complaints will be handled in accordance with GTEC's Complaints Procedure.
19.3 Copies of the Complaints Procedure are available upon request.
20. Governing Law and Jurisdiction
20.1 These Terms and Conditions shall be governed by the laws of England and Wales.
20.2 Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
21. Entire Agreement
21.1 These Terms and Conditions, together with the Privacy Notice, booking confirmation and any documents expressly incorporated by reference, constitute the entire agreement between the parties.
21.2 No verbal representation, promise or statement shall form part of the agreement unless confirmed in writing by GTEC.
21.3 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
